Mandatory SSP Updates

The Employment Rights Act 2025 (ERA 2025) will amend the Social Security Contributions and Benefits Act 1992 to remove the waiting period for statutory sick pay (SSP), making it payable from the first day of sickness absence and to remove the lower earnings limit for SSP eligibility, while introducing a cap of 80% of earnings on SSP. 

The government intends to bring these changes into force on 6 April 2026.

Sick pay policies will need to be amended and payroll will need to be aware so that the correct payments are made.
